TERMS & CONDITIONS

1. Agreement and booking

A booking is confirmed only upon (a) payment of the deposit and (b) written confirmation from me. Until both occur, the date remains open. Payment of the deposit constitutes acceptance of these terms in full.

2. Fees and payment

The deposit is 30% of the quoted fee, payable on booking. It secures the date, compensates me for turning away other bookings for that slot, and is applied toward the total. The balance is due within 7 days of the shoot.

3. Cancellation

Cancellation by the client within 7 days of the shoot results in forfeiture of the deposit. This represents a genuine pre-estimate of my loss from an unfillable slot, declined enquiries, and preparation already performed.

4. Punctuality and duration

The session begins and ends at the scheduled times regardless of client lateness. Time beyond the booked duration, if I can accommodate it, is charged in 30-minute blocks at the extension rate stated in the quotation.

5. Copyright

I retain copyright in all images and footage created. Nothing in this agreement transfers copyright to the client.

Upon full payment, the client receives a perpetual, non-exclusive, non-transferable licence to use the delivered edited images for personal, non-commercial purposes, including printing and social media.

6. Portfolio and promotional use

I may use images from the session in my portfolio, website, social media, printed materials, competition entries, and client pitches. The client consents to my collection, use, and disclosure of images containing their personal data for these purposes. Clients may request in writing before the shoot that images be withheld from public promotional use; a restricted-use surcharge applies.

7. Turnaround

Edited deliverables are sent within 2–3 weeks for 2 hour shoots, and 4–5 weeks for longer shoots. Time runs from the shoot date or the date the balance is paid, whichever is later. Rush delivery is available at a surcharge, subject to my schedule.

8. Style and creative direction

8.1 All images are photographed and edited according to my stylistic decision. My established style is documented at yingframes.mypixieset.com. Any style requirements by the client must be raised before the shoot in writing. Where the client raises nothing before the shoot, the client is deemed to have accepted my stylistic decision.

8.2  Delivered images made in accordance with 9.1 are complete performance of this agreement. Dissatisfaction with a style not raised before the shoot is not a defect, and and any re-edit on that basis is a new instruction chargeable

9. Raw and unedited files

Unedited files are not supplied. Editing forms part of my creative process, and raw files do not represent my work.

10. Force Majeure

I am not liable for any failure to perform where prevented by illness, accident, or any other cause beyond my reasonable control.

In such an event I will use reasonable efforts to arrange a substitute photographer of comparable standard or, failing that, to reschedule to a date agreed with the client. If neither is possible, my liability is limited to a refund of all sums paid.

11. Refunds

Refunds are not given for dissatisfaction with editing style, expression, or subject appearance where the deliverables conform to what was agreed. Nothing in this clause excludes liability for failure to perform the service or for breach of these terms.

12. Limitation of liability

12.1 My total liability arising from or in connection with a booking, whether in contract, tort, or otherwise, is limited to the total fees paid by the client for that booking. I am not liable for indirect or consequential loss. Nothing here limits liability for death, personal injury caused by negligence, or fraud.

12.2 In the event of equipment malfunction, data corruption, or loss of files before delivery, my liability is limited to a refund of sums paid in respect of the affected material.
